REG 04.25.06 Campus Use of Skateboards, Bicycles, and Battery Powered Micromobility Devices

1. PURPOSE AND SCOPE

1.1 This regulation is established to address the safety concerns of the University Community posed by the unsafe use of skateboards, roller skates/blades, bicycles, scooters and similar micromobility devices (to include all battery powered micromobility devices) and to minimize injuries to individuals or damages to University property from the use of these devices.

1.2 Micromobility devices include (but are not limited to) battery-operated devices such as hoverboards (also known as Swagways, IO Hawks, Skywalkers, etc.), electric scooters, electric bicycles, and electric skateboards, and are banned in all campus buildings, including residence halls. This includes the use, indoor possession, storage, operation, and charging of any battery-operated micromobility device. This ban is directly due to the risk associated with the safety of their operation, and the fire risk associated with their use and charging.

1.3 This policy applies to all members of the University Community including, but not limited to, faculty, staff, students, and visitors.

2. ALLOWED USE OF DEVICES

2.1 Skateboarding, rollerblading/skating, and riding micromobility devices is permitted on open campus walkways (but not in roadways either on campus or surrounding campus) as a means of transportation, provided they are operated safely and do not constitute a hazard to pedestrians or disabled persons, and do not disrupt classes or damage property.

2.1.1 Per , bicycles are considered vehicles and can be operated in or on roadways and are subject to all applicable traffic laws and regulations.

2.2 Operators of the listed devices must yield to pedestrians and vehicles, travel at a safe speed, not jump or ride over stops or curbs and remain on smooth paved surfaces.

2.3 Operation of the listed devices in an unsafe manner may subject the operator to disciplinary actions.

2.4 Identification must be provided to Campus Officials upon request.

2.5 Skateboarding, rollerblading/skating, and riding bicycles or other micromobility devices is permitted under the above noted conditions except in the following areas:

2.5.1 Within any University building. (Such devices must be removed prior to entry.)

2.5.2 On prepared sports surfaces such as, but not limited to, the University track, athletic fields, and tennis courts.

2.5.3 The University's Water Feature bridge and adjacent sidewalks.

2.5.4 On any ramp, stairway, wall, bench, or other structure or facility or on or over any landscaped area, including, but not limited to, grass, shrubbery, or flower beds.

2.5.5 In any other areas posted as being prohibited for use by the University (to enhance personal safety, reduce property damage and/or prevent interference with campus operations/programming).

2.6 Recreational use of the above-mentioned devices by groups and/or individuals (i.e., skill demonstrations, sports/competitions, stunts, tricks and uses other than transportation) is prohibited from building entrances, steps, stairs, ramps, walls, sidewalks, parking lots and other general campus space except as part of an approved University competition or function.

2.7 People who are skateboarding, rollerblading/skating, or riding

non-motorized scooters may not be towed by bicycles or other vehicles.

2.8 Any person using a skateboard, roller skates/blades, bicycles, or any micromobility device will be subject to disciplinary action for failure to stop at the scene of an accident where he or she has been involved in property damage and/or injury. Identification must be presented to the other party and the accident reported to the University Police Department.

2.9 Bicycles, when not in use, may only be parked at and secured to bicycle racks. They are not allowed to be secured via chains or other means to handrails, benches, trees, or other fixtures on campus.

2.10 Bicycles or scooters or other micromobility devices found to be secured to handrails may be locked in place by the EHS Office until the owner is identified and referred to Student Conduct or Campus Police (as applicable).

2.11 Bicycles may not be stored inside buildings, hallways, or stairwells on campus.

2.12 Transportation of more than one person on any bicycle or micromobility device is not permitted.

3. VIOLATIONS

3.1 The University may seek compensatory damages from the device owner or user if University property is damaged or destroyed.

3.2 Students, faculty, and staff violating this policy may be subject to disciplinary action (including assessment of a miscellaneous fee), while others that violate this policy will be removed from campus.

3.3. Any University Police officer who observes a person violating this policy may impound the person's skateboard, roller skates/blades, bicycle or micromobility device and hold them at the University Police Department for a twenty-four (24) hour Impoundment period.

 

4. MEDICAL EXEMPTIONS TO THE REGULATION

4.1 In the event that a campus community member requires the use of a previously listed micromobility device as the result of a disability, that individual must obtain permission from the university prior to using the device in a manner that would be otherwise be prohibited by this regulation.
